1. Who we are
Curbside is operated by Friutsnacks ("we", "us", "our"). By accessing or using the Curbside website and services (the "Service"), you ("you", "user") agree to these Terms & Conditions. If you do not agree, do not use the Service.
2. The Service
Curbside is a Software-as-a-Service (SaaS) product. It provides food truck owners with a digital listing on our discovery map and related software tools (verified badge, in-app placement, listing dashboard), sold as a monthly subscription. Customers can browse listings for free.
No physical goods are sold, shipped, or fulfilled through Curbside. We do not sell, prepare, deliver, or process payment for food, beverages, hardware, signage, or any other physical product. Curbside is not a food marketplace and does not handle transactions between consumers and food trucks; consumers order directly from the truck in person.
3. Acceptance & account
You must be of legal age in your jurisdiction to purchase a subscription. You agree to provide accurate information and to keep your account credentials confidential. You are responsible for all activity that takes place under your account.
4. Acceptable use
You agree not to misuse the Service. In particular, you must not:
- Use the Service for any unlawful, fraudulent, or deceptive purpose;
- Infringe anyone's intellectual property or privacy rights;
- Upload malware, spam, or attempt to interfere with the security or integrity of the Service;
- Scrape, probe, or reverse engineer the Service except as permitted by law.
5. Intellectual property
Friutsnacks retains all rights, title and interest in and to the Service, including all software, documentation, branding, and content we provide. You receive a limited, non-exclusive, non-transferable right to use the Service within your selected plan.
6. Payments, subscriptions and refunds
Payments are processed by Stripe, which acts as the Merchant of Record for Curbside orders and handles payment, billing, tax compliance, and invoicing on our behalf. Our own refund window is described in our Refund Policy.
Subscriptions renew automatically each billing cycle until cancelled. You can cancel at any time from your dashboard via the billing portal; access continues until the end of the paid period.
7. Service level
We work hard to keep the Service available and accurate, but we do not guarantee that it will be uninterrupted, error-free, or that listings will produce any particular result. To the fullest extent permitted by law, all implied warranties are disclaimed.
8. Suspension & termination
We may suspend or terminate your access to the Service if you materially breach these Terms, fail to pay amounts due, pose a security or fraud risk, or repeatedly violate our policies. You may stop using the Service at any time.
9. Liability
To the maximum extent permitted by law, our aggregate liability for any claim arising out of or relating to the Service is limited to the fees you paid to us in the twelve months before the claim. We are not liable for indirect, consequential, special, or incidental damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability that cannot be excluded by law.
10. Governing law
These Terms are governed by the laws applicable to Friutsnacks's place of business. Disputes will be resolved in the competent courts of that jurisdiction.
11. Changes
We may update these Terms from time to time. Material changes will be notified through the Service. Continued use after changes take effect constitutes acceptance.
